Our Commitment
ADVISOR-LINK (Pty) Ltd ("ADVISOR-LINK") processes personal information in its capacity as a Responsible Party under POPIA. We are committed to ensuring that all personal information collected through our platform is processed lawfully, fairly, and transparently. This page summarises how we uphold each of the eight conditions for lawful processing set out in POPIA.
The Eight Conditions for Lawful Processing
1. Accountability
ADVISOR-LINK (Pty) Ltd is the Responsible Party. Our designated Information Officer is responsible for ensuring compliance with POPIA across all processing activities.
2. Processing Limitation
We collect only the personal information that is adequate, relevant, and not excessive for the purpose of matching Consumers with Financial Advisors. We do not process sensitive information (e.g., health data) unless explicitly consented to.
3. Purpose Specification
Personal information is collected for a specific, explicitly defined purpose — financial advisor lead matching — and is not processed in a manner incompatible with that purpose.
4. Further Processing Limitation
We do not use personal information for secondary purposes (e.g., direct marketing by third parties) without obtaining fresh consent.
5. Information Quality
We take reasonable steps to ensure that personal information is complete, accurate, and up to date. Advisors and Consumers can update their information at any time via their account settings.
6. Openness
We notify data subjects of the purpose and nature of processing at the point of collection. This POPIA page, our Privacy Policy, and our Terms of Service together constitute our transparency documentation.
7. Security Safeguards
We implement appropriate technical and organisational measures — including TLS encryption, access controls, and regular security reviews — to prevent loss, damage, or unauthorised access to personal information.
8. Data Subject Participation
Data subjects may request access to, correction of, or deletion of their personal information at any time by contacting our Information Officer.
Consent
Consumers who submit a lead-matching request provide explicit consent at the point of submission by ticking the POPIA consent checkbox. This consent covers the sharing of their contact details and financial advice requirements with matched Financial Advisors. Consent may be withdrawn at any time by contacting our Information Officer, after which the data subject's information will be deleted within 30 days.
Lawful Basis for Processing Financial Advisor Data
Financial Advisor data is processed on the basis of a contractual obligation (the Advisor's subscription agreement with ADVISOR-LINK) and to comply with FSCA regulatory requirements. Advisors are required to keep their FAIS licence details and contact information current and accurate.
Cross-Border Transfers
Personal information may be stored on servers located outside South Africa (including cloud infrastructure in the European Union and United States). In such cases, ADVISOR-LINK ensures that the recipient country or organisation provides an adequate level of protection equivalent to POPIA, through contractual safeguards or adequacy determinations by the Information Regulator.
Your Rights
Under POPIA, you have the right to:
- Be notified that your personal information is being collected.
- Access the personal information we hold about you (POPIA Section 23).
- Request correction or deletion of your personal information (POPIA Section 24).
- Object to the processing of your personal information (POPIA Section 11(3)).
- Submit a complaint to the Information Regulator of South Africa.
