Terms of Service

1. Acceptance of Terms

By accessing or using the ADVISOR-LINK platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform. These Terms apply to all users, including consumers seeking financial advice ("Consumers") and registered Financial Advisors ("Advisors").

2. Description of Service

ADVISOR-LINK is a lead-generation and matching platform that connects South African Consumers with FAIS-registered Financial Advisors. We do not provide financial advice ourselves. All advice is provided solely by the matched Financial Advisor, who is independently licensed and regulated by the Financial Sector Conduct Authority (FSCA).

3. Consumer Terms

By submitting a lead-matching request, you confirm that:

  • You are 18 years of age or older.
  • The information you provide is accurate and complete.
  • You consent to your contact details being shared with matched Financial Advisors as described in our Privacy Policy.
  • You understand that ADVISOR-LINK does not guarantee any specific outcome from a consultation with a matched Advisor.
  • The matching service is provided free of charge to Consumers.

4. Financial Advisor Terms

By registering as a Financial Advisor on ADVISOR-LINK, you agree that:

  • You hold a valid FAIS licence issued by the FSCA and will maintain it for the duration of your subscription.
  • All information provided during registration (FSP number, FAIS categories, contact details) is accurate and up to date.
  • You will contact matched leads promptly and professionally.
  • You will not share, resell, or transfer lead data to any third party.
  • You are solely responsible for the financial advice you provide to Consumers.
  • ADVISOR-LINK is not liable for any loss or damage arising from advice provided by you to a Consumer.

5. Subscriptions and Payments

Financial Advisor subscriptions are subject to the following terms:

  • Subscription fees are billed monthly or annually as selected at sign-up.
  • A 14-day free trial is offered on first subscription; no credit card is required to start the trial.
  • Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date.
  • Refunds are not provided for partial billing periods, except where required by the Consumer Protection Act 68 of 2008.
  • ADVISOR-LINK reserves the right to adjust subscription pricing with 30 days' written notice.

6. Lead Disputes

Financial Advisors may dispute a lead within 7 days of allocation if the lead is demonstrably invalid (e.g., incorrect contact details, duplicate, or outside the Advisor's declared service area). Disputes are reviewed by ADVISOR-LINK within 5 business days. Approved disputes result in a lead credit. Advisors with more than 3 approved disputes in a calendar month may be subject to account review.

7. Prohibited Conduct

You may not:

  • Use the Platform for any unlawful purpose or in violation of any applicable South African law.
  • Attempt to scrape, copy, or reverse-engineer any part of the Platform.
  • Harass, intimidate, or misrepresent yourself to any Consumer or Advisor.
  • Submit false or misleading information.
  • Circumvent any security or access control measures.

8. Intellectual Property

All content on the Platform — including the ADVISOR-LINK name, logo, software, text, and graphics — is the property of ADVISOR-LINK (Pty) Ltd and is protected by South African copyright and trademark law. You may not reproduce or distribute any content without our prior written consent.

9. Limitation of Liability

To the maximum extent permitted by applicable law, ADVISOR-LINK shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform or from any financial advice provided by a matched Advisor. Our total liability to you shall not exceed the subscription fees paid by you in the 3 months preceding the claim.

10. Termination

ADVISOR-LINK reserves the right to suspend or terminate any account at any time for breach of these Terms, fraudulent activity, or regulatory non-compliance. Financial Advisors whose FAIS licence lapses will have their accounts suspended immediately pending renewal confirmation.

11. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts of South Africa.
